Terms of Service

1. Acceptance of Terms

By creating an account on Yellsy ("the Service") you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Yellsy SAS ("we", "us", "our") reserves the right to modify these Terms at any time with 30 days' notice by email. Continued use after the notice period constitutes acceptance.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction. By registering you represent that you meet these requirements. Accounts may not be created on behalf of another person without their explicit written consent.

3. Account Registration & Security

You must provide accurate, complete information during registration. Your legal full name is permanently recorded at registration and cannot be changed. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use at [email protected]. Two-factor authentication (2FA) is mandatory for all accounts. We use email or SMS verification codes that expire after 10 minutes.

4. Pricing Model

Yellsy is free to use. There are no subscriptions, no membership plans, and no hidden fees. The price displayed for any flight, hotel, or travel service is the all-in price you pay — inclusive of our platform commission, which is already factored into the shown price. Yellsy earns a commission on completed bookings made through the platform. This commission is reflected in the displayed price and is not added at checkout.

5. Auto-Book Feature

The auto-book feature will automatically book travel at your chosen budget threshold using payment information on file. Before activation, you must explicitly authorize YELLSY to place a temporary card authorization for your selected budget. If a matching travel option is found within your criteria, YELLSY is authorized to complete the booking and charge your card accordingly. If no match is found, no charge is made and the authorization is released automatically. A separate confirmation is required if the final price differs from your stated budget. You may disable auto-book at any time from your dashboard. YELLSY acts as an intermediary — all resulting bookings are with third-party travel providers whose own terms and cancellation policies apply.

6. Third-Party Travel Services

Yellsy is a price monitoring and booking aggregation platform. Actual travel services are provided by third parties (airlines, hotels, car rental companies). We act as an intermediary and are not responsible for the availability, quality, safety, or pricing of such services. Bookings are subject to the terms and conditions of the respective providers.

7. Referral Program

You may earn commissions by referring new users. Commissions are 5% of eligible bookings made by your referrals within 6 months of their registration. Commissions are tracked using anonymous booking identifiers. We reserve the right to withhold or reverse commissions where fraud or abuse is suspected. Full terms at /legal/referral-terms.

8. Prohibited Uses

You must not:

• →Scrape, crawl, or harvest data from the Service
• →Use automated means to access the Service except through our official API
• →Impersonate another person or provide false information
• →Use the Service for any unlawful purpose
• →Attempt to circumvent security measures
• →Resell or redistribute Service data without written permission

9. Intellectual Property

All content, trademarks, software, and materials on Yellsy are owned by YELLSY LLC or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our written consent.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that price monitoring will detect all price changes, that auto-book will execute within any particular timeframe, or that any travel deal will remain available when you attempt to book it.

11. Limitation of Liability

To the maximum extent permitted by law, YELLSY LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of your use of the Service. As an intermediary, YELLSY LLC is not liable for the acts or omissions of third-party travel providers (airlines, hotels, or car rental companies). Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Governing Law & Disputes

These Terms are governed by French law. Any dispute shall first be submitted to good-faith mediation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

13. Termination

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with 30 days' notice except in cases of serious violation. You may delete your account at any time via Settings.
