Referral Program Terms and Conditions

Fixed fee per qualifying booking
Your commission rate and applicable fee tiers are displayed in your referral dashboard after enrollment. All terms below govern how those commissions are earned and paid.
By submitting an application to the Yellsy Referral Program and by accessing your referral dashboard, you agree to be legally bound by these Terms and Conditions in full. If you are applying on behalf of a company or organization, you accept these terms on that entity's behalf and confirm that you have authority to do so. These terms supplement our Terms and Conditions and Acceptable Use Policy, which also apply to your use of the Platform.
1. Program Overview and Scope
The Yellsy Referral Program ("Program") is a performance-based marketing partnership open to professional publishers, content creators, travel bloggers, media companies, and digital marketing agencies (collectively referred to as "Partners"). The Program allows Partners to earn fixed fee commissions by driving new, paying customers to the Yellsy platform at yellsy.com.
These terms govern the entire relationship between Yellsy LLC and the Partner, from enrollment through to payout and termination. They apply to all tracking links, marketing materials, and commission transactions conducted under the Program.
2. Eligibility and Enrollment
To be eligible for the Referral Program, you must meet all of the following criteria at the time of application and throughout your participation:
Enrollment is not automatic. Yellsy LLC reviews all applications and reserves the right to accept or reject any application at its sole discretion, without being required to provide a reason. Approved Partners will receive confirmation by email and access to their referral dashboard.
Yellsy LLC also reserves the right to revoke approval at any time if the Partner's content or promotional methods are found to be inconsistent with the standards described in these terms.
3. Independent Contractor Status
The relationship between Yellsy LLC and the Partner is that of independent contractors. Nothing in these terms creates an employment relationship, partnership, joint venture, agency, or franchise between the parties. The Partner has no authority to make any representation or commitment on behalf of Yellsy LLC, to enter into any agreement in Yellsy LLC's name, or to bind Yellsy LLC in any way.
The Partner is solely responsible for all costs and expenses associated with their marketing activities, including but not limited to website hosting, advertising spend, content creation, and any employment or contractor costs on their end. Yellsy LLC does not reimburse marketing expenses and makes no guarantee of earnings from participation in the Program.
4. Tracking Assets and Technical Access
Upon enrollment, Yellsy LLC will provide the Partner with one or more of the following tracking assets via the referral dashboard:
Unique referral link
A trackable URL that attributes traffic from the Partner's properties to their account.
Promotional codes
Alphanumeric codes that users enter at checkout, linked to the Partner's account.
Tracking banners
Pre-approved creative assets containing embedded tracking for display placements.
The Partner must use only the tracking assets provided through their official dashboard. Modification of tracking links in any way that alters their destination, appends unauthorized parameters, or bypasses our attribution system is strictly prohibited.
The Partner may not attempt to access, test, reverse engineer, or directly connect to Yellsy LLC's internal booking APIs, pricing infrastructure, or supplier connections outside of the official partner integration. Any such attempt will result in immediate termination.
5. Qualifying Transactions and Commission Attribution
A commission is generated only when a "Qualifying Transaction" occurs. The following conditions must all be met simultaneously for a transaction to qualify:
Click through referral link
The user must access yellsy.com through the Partner's unique tracking link or use the Partner's promotional code at checkout. Direct traffic or traffic from other sources does not generate a commission for the Partner.
New customer
The referred user must be a new customer who has not previously registered an account or made a purchase on Yellsy. Self-referrals (the Partner purchasing under their own link) do not qualify.
Attribution window
The user must complete their purchase within thirty (30) calendar days of their first click on the Partner's tracking link. This window is tracked via a secure session cookie placed at the time of the click.
Successful payment
The booking must be fully paid through our payment infrastructure. Partial payments, trial activations, and free-tier registrations do not qualify.
No cancellation or chargeback
The booking must not be cancelled within the provider's refund window, result in a technical processing error refund, or be reversed through a chargeback. Commissions on cancelled or refunded transactions are reversed accordingly.
In the event of a technical tracking failure on our side, Yellsy LLC will make reasonable efforts to manually attribute confirmed transactions upon written request. Tracking gaps caused by the user clearing cookies, using private browsing, or blocking tracking scripts cannot be attributed retroactively.
6. Commission Structure
Partners earn a fixed fee per Qualifying Transaction, regardless of the total value of the travel package purchased. The fixed fee model was chosen deliberately: because Yellsy sources travel inventory at wholesale net rates, no flexible commission percentage can be applied without compromising the pricing integrity of our service.
How commissions are determined
Yellsy LLC reserves the right to adjust commission fee tiers with thirty (30) days' prior notice to the Partner. Changes apply only to transactions occurring after the effective date of the adjustment. Commissions already earned and confirmed are not affected by rate changes.
7. Payment and Payout Conditions
Commissions are reviewed and paid on a monthly basis. The following conditions apply to all payouts:
Minimum payout threshold
Displayed in your dashboard. Accumulated commissions below the threshold roll over to the following month.
Payout method
Bank transfer (IBAN) or PayPal, as configured in your dashboard.
Processing time
Payouts are initiated within 10 business days of the end of the applicable month.
Currency
Payouts are issued in the currency displayed in your dashboard. Exchange rate risk is borne by the Partner.
Transaction fees
Yellsy LLC may deduct unrecoverable payment gateway processing fees from the payout amount. The net amount will always be communicated before processing.
Payouts will not be released until the Partner has provided all required tax documentation as requested by Yellsy LLC, including applicable forms such as W-9 (US persons) or W-8BEN (non-US persons). Failure to provide these documents within thirty (30) days of request may result in payout suspension.
The Partner is solely responsible for declaring, reporting, and paying all taxes, levies, and social contributions applicable to commission income in their jurisdiction. Yellsy LLC does not withhold taxes on behalf of Partners outside of any legal obligation to do so.
8. Marketing Standards and Brand Use
Partners must represent Yellsy LLC honestly and accurately in all promotional materials. The following standards apply to all marketing activities conducted under the Program:
Truthful claims
You may not make false, exaggerated, or misleading claims about Yellsy's features, pricing, availability, or results. All statements must be accurate and verifiable at the time they are published.
Disclosure of referral relationship
You must clearly disclose your referral relationship with Yellsy in all promotional content where a commission may be earned, in accordance with applicable advertising regulations (including FTC guidelines in the United States and equivalent rules in other jurisdictions).
Keyword bidding restrictions
You may not bid on pay per click advertising networks using branded keywords including "Yellsy", "Yellsy LLC", "yellsy.com", or any confusingly similar misspelling. You may bid on generic travel search terms. Violation of this rule may result in immediate termination and recovery of commissions earned during the period of violation.
Approved brand assets only
Promotional materials must use only the logos, banners, and copy provided through your referral dashboard or explicitly approved in writing by Yellsy LLC. Unauthorized modifications to our brand assets are not permitted.
No spam or unsolicited messages
You may not promote Yellsy through unsolicited email campaigns, text message spam, or any method that violates applicable anti-spam laws.
Yellsy LLC reserves the right to request changes to Partner promotional content that it believes is inaccurate, misleading, or damaging to the Yellsy brand. Partners must comply with such requests within five (5) business days of receipt.
9. Prohibited Conduct and Fraud Prevention
Yellsy LLC actively monitors partner traffic, conversion patterns, and payout requests to detect fraudulent activity. The following conduct is strictly prohibited and will result in immediate account termination, forfeiture of all pending commissions, and potential legal action:
Cookie Stuffing
Using invisible iframes, browser extensions, scripts, or any other method to place tracking cookies on users who have not voluntarily clicked a Partner tracking link. This is a form of attribution fraud and will be treated as such.
Artificial Traffic Generation
Directing automated bot traffic, incentivized clicks, or paid traffic schemes through tracking links in a way that inflates click volume without generating genuine purchase intent. Traffic must come from real users with authentic interest in travel services.
Self-Referral and Collusion
Purchasing through your own referral link, coordinating with other accounts to generate artificial commissions, or fabricating transactions in any form.
Excessive Search Load
Using referral traffic channels to generate excessive automated search queries on the platform in a way that burdens our infrastructure or triggers rate limiting from our technology partners.
Misleading Content
Publishing content that deliberately misrepresents Yellsy's service, prices, or capabilities in order to generate clicks or sign-ups under false pretenses.
10. Privacy and Data Handling
Partner commission records in the dashboard display only anonymized booking identifiers. Partners do not have access to the personal information of users who arrived through their links, including names, email addresses, passport details, or payment data.
If the Partner collects any personal data from their own audience in connection with their promotional activities (for example, through an email sign-up form or a lead magnet), they are solely responsible for ensuring that collection and processing is lawful under applicable data protection regulations, including the GDPR where applicable.
Yellsy LLC's processing of user data in connection with referral tracking is covered under our Privacy Policy. The Partner acknowledges that a tracking cookie is placed on referred users' devices for the duration of the attribution window, as described in Section 5.
11. Intellectual Property
The Yellsy name, logo, trademarks, and all associated brand assets are the exclusive property of Yellsy LLC. Participation in the Referral Program grants the Partner a limited, non-exclusive, non-transferable, revocable license to use the brand assets provided through the referral dashboard solely for the purpose of promoting the Yellsy platform in accordance with these terms.
This license does not permit the Partner to register any domain name, social media handle, or business name that incorporates the Yellsy brand or any confusingly similar variant. It does not permit the Partner to sublicense the brand to third parties or to use it in any context unrelated to the Referral Program.
The Partner retains ownership of the content they create to promote Yellsy. By publishing such content, the Partner grants Yellsy LLC a non-exclusive, royalty-free license to reference or share it (for example, in a testimonials section or case study), with attribution. Yellsy LLC will request permission before using any Partner content in a paid promotional context.
12. Limitation of Liability and Indemnification
Yellsy LLC provides its referral tracking infrastructure and dashboard on an "as is" and "as available" basis. We do not guarantee uninterrupted availability of tracking systems or accuracy of real-time commission reporting. Where tracking data is lost due to circumstances outside our reasonable control, we will make reasonable efforts to reconstruct attribution from server logs upon written request.
Yellsy LLC's liability to the Partner under or in connection with this agreement is limited to the total amount of commissions earned and confirmed by the Partner in the six months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, or lost profit claims arising from the Partner's participation in the Program.
The Partner agrees to indemnify, defend, and hold harmless Yellsy LLC and its officers, directors, and employees from and against any claims, damages, losses, or legal expenses arising from: (a) the Partner's promotional materials or marketing activities; (b) the Partner's violation of these terms or applicable law; (c) any claim that the Partner's content infringes a third party's intellectual property rights.
13. Term, Suspension, and Termination
This agreement begins on the date the Partner's application is approved and continues until terminated by either party. Either party may terminate the agreement at any time by providing written notice to the other party, or by using the account closure function in the referral dashboard.
Termination by Yellsy LLC
We may terminate this agreement immediately and without prior notice in the event of a material breach of these terms, suspected fraud, repeated policy violations, or any conduct that we determine poses a risk to our platform, users, or partners.
Termination by the Partner
You may terminate at any time by notifying us in writing at contact@yellsy.com or using the account closure function. Pending commissions from Qualifying Transactions confirmed before your termination date will be paid at the next monthly payout cycle, subject to the minimum payout threshold.
Effects of Termination
Upon termination: all rights to generate future commissions cease immediately; all tracking links become inactive; the Partner must remove all Yellsy brand assets from their properties within fourteen (14) calendar days. Commissions associated with verified fraud are permanently forfeited regardless of termination cause.
Yellsy LLC also reserves the right to suspend a Partner's account temporarily while a fraud investigation is in progress. During suspension, commission accumulation is paused and pending payouts are held. We will communicate the reason for suspension within five (5) business days of initiating it.
14. Commission Disputes
If you believe a commission has been incorrectly attributed, omitted, or reversed, you may submit a dispute within sixty (60) calendar days of the relevant transaction date. Disputes submitted after this deadline will not be reviewed.

15. Governing Law and Dispute Resolution
These Referral Program Terms and Conditions are governed by and construed in accordance with the laws of the United States and the jurisdiction in which Yellsy LLC is legally registered. Any dispute arising out of or in connection with this agreement that cannot be resolved amicably through direct communication shall be submitted to the competent courts of that jurisdiction.
Before initiating any formal legal proceedings, both parties agree to attempt to resolve the dispute in good faith through direct written communication for a period of no less than thirty (30) calendar days from the date the dispute is first raised in writing.
16. Modifications
Yellsy LLC may update these Referral Program Terms at any time. Material changes will be communicated to active Partners by email at least thirty (30) days before they take effect. Non-material changes (such as clarifications that do not alter rights or obligations) may be made with shorter notice.
Your continued participation in the Program after the effective date of any update constitutes your acceptance of the revised terms. If you do not agree with a change, you may terminate your participation before the effective date without forfeiting commissions already earned.
